On Monday, Dec 30, the United States Court of Appeals for the Tenth Circuit heard oral arguments in the case, that brought the case on the basis of whether the city, in its actions to collect water last year after the city’s use of a public land it owns were protected by federal and state laws.
This is a major decision if the courts uphold the right to water on the part of the states. The court is issuing a new rule by way of which States are required to give water of different concentrations and types to agencies, including Water Conservation Districts of Utah. The rule is also intended to keep a focus on the health implications to the citizens of Utah. It states that as of that time, if the Water Conservation District has established that a city has violated the Constitution, then the state may do “meaningful” disuse of some of those water sources or then refuse to issue water to the Water Conservation District because of that violation. The judges wrote that, while states have the power to restrict the use and discharge of water since they establish health risk, that does not mean they have the power to force a city to grant water to anyone without informing that use or discharge.
